The Importance of the Habitability Certificate

The habitability certificate (cèdula d'habitabilitat) is an official document that confirms a property meets the minimum conditions required for residential use. Although it is not required in every Spanish autonomous community, in Catalonia it is an essential document for selling, renting or activating basic utility supplies.

What exactly is the habitability certificate?

It is an official document issued by the regional government certifying that a property meets the minimum habitability requirements: floor area, ceiling height, ventilation, water and electrical installations, and sanitation, among other criteria.

Types of certificate

  • First occupation: for newly built properties that have never been inhabited
  • First occupation following renovation: for properties that have undergone a full refurbishment
  • Second occupation: for existing properties that need to renew their certificate

When do you need a habitability certificate?

In Catalonia, the habitability certificate is mandatory in order to:

  • Sell a property: the seller must provide the buyer with a valid certificate
  • Rent a property: the landlord must hold a valid certificate at the time of signing the tenancy agreement
  • Activate utility supplies: water, gas and electricity connections require a valid certificate
  • Apply for a mortgage: many lenders require it as part of the documentation

How to obtain a habitability certificate

The process for obtaining or renewing a habitability certificate involves the following steps:

  1. Request an inspection: engage a registered architect or technical architect to inspect the property
  2. Habitability report: if the property meets the requirements, the professional issues the certificate
  3. Professional visa: the certificate must be endorsed by the relevant professional association
  4. Registration: submit the application together with the endorsed certificate to the competent authority

Timescales and costs

The cost of the technical inspection typically ranges between 100 and 200 euros, depending on the professional and the location. Administrative fees are approximately 20–40 euros. Processing times usually range from 1 to 3 months, although this may vary in practice.

Validity of the certificate

The habitability certificate is valid for 15 years in the case of second-occupation certificates. First-occupation certificates are valid for 25 years. Once expired, the certificate must be renewed following the same procedure.

What happens if you do not have a certificate?

Operating without a habitability certificate can have serious consequences:

  • You will not be able to complete the sale before a notary (in Catalonia)
  • You will not be able to sign a legally valid tenancy agreement
  • Utility companies may refuse to activate services
  • The property owner may be subject to administrative penalties
